The November 10 deadline for 178 Section 301 exclusions: how to check coverage
USTR's December 2025 notice extends 178 current product exclusions. Its DATES section extends them through “11:59 p.m. eastern daylight time on November 9, 2026.” Its annexes apply the extension to goods entered for consumption, or withdrawn from warehouse for consumption, before that timestamp. Use the notice's wording when reviewing an entry with your customs broker.
Identify the group before checking your product
The notice traces part of this group to the 164 exclusions extended in May 2024. It also identifies fourteen exclusions covering certain solar manufacturing equipment announced in September 2024. Annex A covers heading 9903.88.69 and U.S. notes 20(vvv)(i), 20(vvv)(ii), 20(vvv)(iii), and 20(vvv)(iv) to subchapter III of chapter 99 of the HTSUS. Annex B covers heading 9903.88.70 and U.S. note 20(www) to that subchapter.
Match the product description as well as the number
The notice says the scope of each exclusion is governed by the ten-digit HTSUS statistical reporting numbers and the product descriptions in those notes. It also says the extensions are available for any product meeting the description in the product exclusion. Don't decide that a product qualifies from a tariff number alone; compare its specifications with the relevant description. Ask your broker to identify the precise note and description relied on, then mark any product details that still need confirmation.
Open USTR's exclusions document index to locate the earlier notices, then compare the relevant descriptions with the notes identified in the extension notice.
Check the entry event and any later notice
Annexes A and B specify entry for consumption or withdrawal from warehouse for consumption, rather than an order date. Ask your broker which entry event and timestamp apply to your shipment before relying on the exclusion. USTR says it may continue to consider further extensions or additional modifications. Check for a later final notice before using this deadline for an entry decision.
